1. Acceptance of Terms
By accessing or using Carbuy.online ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Carbuy.online is an online marketplace that connects buyers, sellers, and licensed dealers of new and used vehicles. We provide listing, search, comparison, research, and communication tools.
Carbuy.online is not a party to any actual vehicle transaction between users. We do not own, sell, finance, inspect, broker, transport, deliver, or title vehicles. Any transaction is between the buyer and the seller (or dealer).
3. User Accounts & Responsibilities
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You agree to provide accurate, current, and complete information and to keep it updated.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- Notify us promptly of any unauthorized use of your account or other security incident.
4. Listing Content Rules
Sellers and dealers are solely responsible for the accuracy and legality of their listings, including:
- Truthful vehicle descriptions: year, make, model, trim, mileage, condition, accident/title history, and VIN.
- Authentic photographs of the actual vehicle being offered.
- Accurate pricing and disclosure of all material defects.
- Compliance with all applicable consumer-protection, advertising, and disclosure laws.
Prohibited listing content includes stolen vehicles, vehicles without lawful title, salvage vehicles misrepresented as clean-title, vehicles you are not authorized to sell, and any content that is fraudulent, misleading, infringing, or unlawful.
5. Buyer/Seller Conduct & Disclaimers
Buyers are responsible for independently verifying any vehicle they are interested in — including inspecting the vehicle, requesting a vehicle history report, arranging professional inspection, verifying title status, and confirming all material facts before purchase.
Carbuy.online is not responsible for the condition, safety, legality, or value of any vehicle listed; for the truthfulness of listings; or for the conduct of any user. We do not mediate, arbitrate, or guarantee any transaction between users.
6. Pricing & Payments
Browsing and basic listings on Carbuy.online are free for individual consumers. Dealer accounts, featured listings, and premium placements may carry fees, which will be disclosed before purchase. All fees are non-refundable except as required by law or as expressly stated at the point of purchase. We may change fees at any time on prospective notice.
7. Intellectual Property
The Carbuy.online name, logo, website, software, and editorial content are owned by Carbuy.online or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or reverse-engineer any portion of the Service without our prior written consent.
By posting content (listings, photos, reviews) you grant Carbuy.online a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the Service.
8. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or to violate any rights of others.
- Post false, misleading, fraudulent, defamatory, harassing, obscene, or infringing content.
- Scrape, crawl, harvest, or collect data from the Service except via APIs we expressly authorize.
- Circumvent, disable, or interfere with security or rate-limiting features.
- Send spam or unsolicited commercial communications to other users.
- Impersonate any person or entity or misrepresent your affiliation.
- Upload viruses, malware, or other harmful code.
9. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBUY.ONLINE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY VEHICLE TRANSACTION. Our aggregate liability for any claim relating to the Service will not exceed the greater of $100 or the amounts you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Carbuy.online and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your content or listings; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property, privacy, or consumer-protection right.
11. Termination of Access
We may suspend or terminate your account or access to the Service at any time, with or without notice, for any reason, including violation of these Terms or any conduct that we determine harms other users or the Service. You may close your account at any time from your account settings.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Applicable consumer-protection laws of your place of residence may also apply.
13. Dispute Resolution
Most disputes can be resolved by contacting our support team. If a dispute cannot be informally resolved, you and Carbuy.online agree to resolve any claim arising out of or relating to these Terms or the Service through binding individual arbitration administered by a recognized arbitration provider, except for claims that may be brought in small-claims court. You and Carbuy.online waive any right to a jury trial and to participate in a class action, to the extent permitted by law.
14. Changes to Terms
We may update these Terms from time to time. When we make material changes we will update the "Last Updated" date and, where appropriate, notify users by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
